The amount payable depends on the value of the inherited assets, the degree of kinship and the heir’s pre-existing wealth. In addition, if the deceased lived outside Spain, it may be necessary to file Form 720 to declare overseas assets exceeding €50,000.

EU Succession Regulation 650/2012 allows the will to specify whether Spanish or Swedish law applies to the estate. 

Sweden has had no inheritance tax since 2004, but Spain does, so a Swedish citizen with assets in Spain is taxed here regardless of the position in their home country. Choosing the applicable law and planning ahead helps avoid conflicts between the two legal systems.
